Bengaluru court says Kinetic Green cannot use Zulu name

    The name Zulu was sounding very close to Yulu, which prompted the latter to file a suit.

    In a legal battle over trademark infringement, a Bengaluru commercial court upheld a temporary injunction against Kinetic Green Energy and ruled in favour of Bajaj-owned Yulu. This injunction stops Kinetic Green from using, selling and advertising its Zulu e-scooter. This discussion comes following a dispute initiated by Yulu, alleging trademark violation with the launch of Kinetic Green’s Zulu e-scooter in December 2023.

    Kinetic Green vs Yulu trademark dispute continues

    The conflict began in late January when Yulu filed a case with the city civil and sessions court, accusing Kinetic Green of infringing on its trademark rights. Although the initial injunction request by Yulu was denied, Kinetic Green was given an opportunity to present their arguments. Dissatisfied with the court’s decision, Yulu appealed to the High Court of Karnataka, which partially granted a temporary injunction in February, urging the commercial court to expedite the hearing process. 

    In defence, Kinetic Green Energy’s legal representatives emphasised that the adoption of the Zulu mark was rooted in by Sulajja Firodia Motwani, the founder and CEO of Kinetic Green, followed by the tagline “Sulu ki Zulu”, which rhymed with Sulajja’s nickname. They also highlighted the consistent naming pattern of their previous products, all following a four letter format. They also underlined the fact that the trademark was registered before its utilisation in the market.

    With the injunction now upheld against Kinetic Green Energy, the legal proceedings continue as the commercial court proceeds with the hearing. Both parties are expected to present further arguments and evidence to support their respective claims, marking the continuation of this trademark dispute.
